Abstract:
本次演講探討的是台灣中學教科書的常見名詞:治外法權。長久以來,我國官方皆將之視為晚清簽訂不平等條約的一部分,是中國法律落後的象徵。然而,近來研究者發現,滿清作為一個統治多民族的帝國,本來即採行法律多元主義,不同族群適用不同法律(如蒙古人適用蒙古法),故當西方諸國提出其公民在中國的行為應依其本國法時,中國並未反對。另一方面,對美國而言,管制其公民在中國的行為(例如開設妓院、賭場)成本甚高。如何有效的治理,實為一大問題。本次演講將從美國的檔案出發,重訪治外法權的實際運作,並反思既有的歷史解釋。
